Addendum for Korean Residents

Effective Date: November 14, 2024

 

This addendum supplements the Privacy Policy of Macnica, Inc. and its group of companies (hereinafter referred to as "Company" or "we") and applies to residents of the Republic of Korea (hereinafter referred to as "Data Subjects" or "you") to comply with the Personal Information Protection Act of Korea (hereinafter referred to as "PIPA"). Unless otherwise stated, the terms used herein have the same meaning as those defined in the PIPA. For Data Subjects, this addendum shall prevail over Privacy Policy of Macnica, Inc. and its group of companies.

 

Please note that for the processing of the personal information of residents of the Republic of Korea, MACNICA Korea,Limited would act as the data contoller under the PIPA.

 

1. Information Collected by the Company

1.1 We collect and use the following personal information based on the legal basis specified below.

• Information of employees of the Company’s business partners or users, such as name, name of the company/department to which the employee or user belongs, title, address, telephone number, facsimile number, e-mail address, other contact information, online identifier, support site browsing history, and information on the purchase, use, or consideration of goods or services;

• Other personal information contained in the logs of devices in which products are installed; and

• Users’ accounts, passwords, and account history.

 

<In relation to AI>

• Information of employees of the Company’s business partners or users, such as name, date of birth, sex, height, weight, name of the company/department to which the employee or user belongs, title, address, telephone number, facsimile number, e-mail address, other contact information, area of residence, and location information;

• Appearance contained in videos shot with cameras; and

• Users’ accounts, passwords, and account history.

• Information of employees of the Company’s business partners or users, such as name, date of birth, name of the company/department to which the employee or user belongs, title, address, telephone number, facsimile number, e-mail address, online identifier, and information on the purchase, use, or consideration of goods or services

 

The above personal information will be collected and used for the purposes listed in 2.(2) Provision of goods and services under the Privacy Policy of Macnica, Inc, and will be retained for the period necessary for the performance of the contract with the data subject.

• Employee’s name, name of the dispatching company, department name, title (including internal grade), address, telephone number, facsimile number, e-mail address, nationality, place of birth, head of household, sex, date of birth, date of hire, educational history, career history, employee number, work records, performance evaluation, status of leave of absence, salary, records of rewards, punishments, etc., qualifications, skills, account information, personal identification materials, family information, foreign registration identification number, and basic pension number.

 

The above personal information will be collected and used for the purposes listed in 2.(3) Human resources management under the Privacy Policy of Macnica, Inc, and will be retained for the period necessary for the performance of the contract with the data subject or the obligations under the law, or as required by special provisions under the law.

• Personal information of the Company’s shareholders, such as name, address, telephone number, facsimile number, and e-mail address;

• Name, date of birth, sex, address, telephone number, e-mail address, educational history, career history, current annual income, desired annual income, qualifications held, reasons for application, or other necessary information of job seekers that is obtained from the job seekers when they register, transmit or submit their resume, curriculum vitae, entry sheet, etc. to the Group in relation to the Group’s recruiting activities; information contained in any form of communication between the Company and a job-seeker during dialogues, communications and telephone calls between the Company and job seekers (including, without limitation, communications at interviews), information incidental to or derived from such information, and other necessary information; and personal information necessary for recording the history of application for or participating in the Company’s recruiting activities, and the results of the employment screening, such as the fact of being a job seeker or the history of applying for the job, status in the recruiting activities, and the Company’s evaluation and decision on the job seeker;

• Appearance of customers, employees, or others concerned contained in videos shot with cameras installed in the facilities operated by the Company;

• Name, e-mail address, other contact information, passport number, and license number of the Company’s employees; and

• Information of employees of the Company’s business partners, such as name, name of the company/department to which the employee belongs, title, telephone number, facsimile number, e-mail address, other contact information, entry/exit information, and other personal information contained in the logs of rent devices.

 

The above personal information will be collected and used for the purposes listed in 2.(4) Other administrative procedures of the Company under the Privacy Policy of Macnica, Inc, and will be retained for the period necessary for the performance of the contract with the data subject or to fulfill our legitimate interests.

1.2. We collect and use the following personal information with your consent. Such personal information will be collected and used for the purposes listed in 2. Purpose of use of personal information under the Privacy Policy of Macnina, Inc, and will be retained until the purposes of processing have been achieved, or until you withdraw consent.

Marketing activities

• Personal information of customers obtained through business activities and products handled by the Company, such as name, name of the company/department to which the customer belongs, title, address, telephone number, facsimile number, e-mail address, and other contact information; 

• Name card information obtained through sales activities;

• Personal information of job seekers obtained through recruiting, such as name, age, sex, address, educational history, and career history;

• Personal information of persons who applied for or participated in seminars, events, exhibitions, or other similar occasions hosted, co-hosted, or participated by the Company, such as name, name of the company/department to which the person belongs, title, address, telephone number, facsimile number, e-mail address, online identifier, and information on the purchase, use, or consideration of goods or services;

Personal information entered on a Website that is operated by the Company or whose operation is outsourced by the Company, Web pages viewed, or other data; and

• Contact information of business partners such as name, title, address, telephone number, facsimile number, e-mail address, and entry/exit information, and appearance contained in videos shot with cameras.

• Health-related information of users, such as body fat percentage, body temperature, heart rate, blood pressure, or other vital data, sleep data, brain waves, athletic ability (results of various measurements), medical history, oral health status, and skeletal muscle mass

• Medical history (handicap), medical examination results, browsing history, search history, hobbies, and behavior information on the Internet or other electronic networks

3. Overseas Transfers of Personal Information

As a global organization, we may need to transfer your personal information outside the Republic of Korea to other jurisdictions. These countries may have data protection laws that are different from the laws of your region. We will only transfer personal information to another country in accordance with applicable data protection laws, and provided that there are adequate levels of protection in place for the processing of data. You may refuse the overseas transfer of personal information by contacting the Chief Privacy Officer. If you refuse the overseas transfer, however, there may be certain inconveniences affecting your use of our services.

4. Data Security Measures

We employ a variety of administrative, technical, and physical measures to keep your personal information safe to help ensure that it is used in accordance with the Privacy Policy of Macnica, Inc. The specific security measures we implement are set forth below:

 

• Administrative measures: Establishment and implementation of an internal management plan, operation of a team dedicated to data security, and providing regular employee training, etc

• Technical measures: Management of access rights to the personal information processing system, implementation of an access control system, encryption of personal information, installation and updates of security programs, etc.

• Physical measures: Access control to the computer room and data storage room, etc.

5. Data Retention and Destruction

We will retain your personal information for the period necessary to fulfill the purposes outlined in the Privacy Policy of Macnica, Inc. unless longer retention is necessary to comply with applicable laws and requirements. When we no longer need to use your personal information, we safely and securely destroy such information, according to the procedures and methods of destroying personal information as set forth below:

 

• Destruction Procedure: We select the personal information for which needs to be destroyed, and destroy the personal information through appropriate procedures

• Destruction Method: We destroy personal information recorded and stored in electronic files so that the records cannot be reproduced, and destroy personal information recorded and stored in paper documents by the way that are not realistically feasible to restore, such as dissolution, shredding or incineration.

We designate a Chief Privacy Officer as below to take full responsibility for the handling of personal information and to deal with complaints and reliefs for damages of Data Subjects related to personal information processing.
