MACNICA, Inc., and MACNICA HOLDINGS, INC. and its group companies (the “Company”) fully utilize its function as a technology distributor in the fields of electronics and information communications, to develop global suppliers and to conduct or provide planning and development, marketing, sales, technical support, various service solutions, and communication services for its products. The Company is conscious of its important duty to properly manage large volumes of personal information relating to customers, business partners, shareholders, employees, and others concerned that are acquired through these activities. The Company will continue to take measures to protect personal information based on the following Privacy Policy.

Basic Policy
- The Company lawfully handles personal information in accordance with the Act on the Protection of Personal Information (the “Personal Information Protection Act”), laws and regulations relating to the same Act (the “Laws and Regulations”), guidelines relating to the same Act (the “Guidelines”), and other related rules.
- The Company establishes rules and manuals concerning the protection of personal information to promote the development of internal rules, implementation of security measures, and education and training for the protection of personal information, and ensures that persons concerned are fully aware of such rules and manuals.
- The Company acquires personal information for the purposes of use that are clearly specified in advance and only to the extent necessary to achieve the purposes.
- The Company does not provide personal information of any person to third parties unless the customer has agreed to the provision or the provision is based on Laws and Regulations, or other rules.
- The Company takes necessary and appropriate security measures against risks concerning personal information (such as unauthorized access to personal information, and loss, destruction, alteration, and leakage of personal information).
- The Company complies with the Laws and Regulations, Guidelines, and other rules, and continuously improves its personal information protection program.
The Company establishes a consultation desk to address complaints and inquiries from customers regarding the handling of personal information by the Company and the personal information protection program.
Handling of Personal Information

The Company acquires personal information by lawful and fair means.

The Company uses personal information of customers, business partners, shareholders, employees, and others concerned for the purposes set forth below:

• To ensure the security of customer’s equipment/devices/data/communications;
• To provide maintenance and support for goods and services;
• To identify users to provide goods and services; and
• To otherwise contact business partners in relation to transactions, etc. and perform business operations based on individual transactions.

• To contact customers throughout the process from the purchase for, and up to the provision of, goods and services handled by the Company;
• To provide maintenance and support for goods and services;
• To identify users to provide goods and services;
• To determine the health status/athletic ability of users;
• To provide personalized services, and develop or improve the Company’s services based on the user information obtained by the Company and the results of the analysis thereof (profiles);
• To support research and academic activities, including the publication of papers, in the medical and health fields;
• To develop/improve/ control/operations of autonomous vehicles;
• Sales to AI developers; and
• To otherwise contact business partners in relation to transactions, etc. and perform business operations based on individual transactions.

(3) Human resources management
• To perform procedures for pre-employment screening, procedures for joining the Company, procedures for social insurance, and other procedures necessary for employment management;
• To provide educational opportunities, prepare development plans, and otherwise develop education and training environments;
• To perform business operations related to wages, rewards, punishments, company pensions, group insurance, accident compensation, etc.;
• To properly manage the health of employees and their families;
• To provide benefit programs for employees and their families;
• To take measures necessary for business operations (including shooting PR videos or other PR activities) and business activities;
• To contact resigned or retired employees and their families; and
• To perform business operations incidental to the foregoing.
(4) Other administrative procedures of the Company
• Exercise of rights under the Companies Act by shareholders, performance of obligations by the Company, and provision of various support or services by the Company to its shareholders;
• To take various measures to smooth the relationships between the Company and its shareholders, other administrative procedures relating to shares such as the preparation of data based on various Laws and Regulations, and hold or make various events, questionnaires, and other plans of the Company;
• To contact and provide information for the employment screening of job seekers;
• To ensure the security of customers and employees in or outside the facilities operated by the Company;
• To execute agreements/acquire consents;
• To manage outsourced services;
• Internal audit; and
• Other purposes agreed in advance by customers, and administrative procedures relating to the Company’s employees.
(5) Provision to third parties
• To provide maintenance services for products sold by the Company to customers, execute software licensing or other agreements, and provide various goods, services, and solutions;
• To hold seminars or webinars hosted or co-hosted by the Company; and
• Sales to AI developers.
3. Details of personal information to be acquired
To the extent necessary for achieving the purposes of use specified in 2. above, the Company acquires personal information and personal data of customers, business partners, shareholders, employees, and others concerned by lawful and proper means.

• Information of employees of the Company’s business partners or users, such as name, name of the company/department to which the employee or user belongs, title, address, telephone number, facsimile number, e-mail address, other contact information, online identifier, support site browsing history, and information on the purchase, use, or consideration of goods or services;・Other personal information contained in the logs of devices in which products are installed; and
• Users’ accounts, passwords, and account history.
<In relation to AI>
• Information of employees of the Company’s business partners or users, such as name, date of birth, sex, height, weight, name of the company/department to which the employee or user belongs, title, address, telephone number, facsimile number, e-mail address, other contact information, area of residence, and location information;
• Appearance contained in videos shot with cameras;
• Health-related information of users, such as body fat percentage, body temperature, heart rate, blood pressure, or other vital data, sleep data, brain waves, athletic ability (results of various measurements), medical history, oral health status, and skeletal muscle mass; and
• Users’ accounts, passwords, and account history.
<Others>
• Information of employees of the Company’s business partners or users, such as name, date of birth, name of the company/department to which the employee or user belongs, title, address, telephone number, facsimile number, e-mail address, online identifier, and information on the purchase, use, or consideration of goods or services; and
• Users’ electromyographic data.
(3) Human resources management
• Employee’s name, name of the dispatching company, department name, title (including internal grade), address, telephone number, facsimile number, e-mail address, nationality, place of birth, head of household, sex, date of birth, date of hire, medical history (handicap), educational history, career history, employee number, work records, performance evaluation, status of leave of absence, salary, records of rewards, punishments, etc., browsing history, medical examination results, search history, hobbies, qualifications, skills, behavior information on the Internet or other electric networks, account information, personal identification materials, family information, foreign registration identification number, and basic pension number.
(4) Other administrative procedures of the Company
• Personal information of the Company’s shareholders, such as name, address, telephone number, facsimile number, and e-mail address;
• Name, date of birth, sex, address, telephone number, e-mail address, educational history, career history, current annual income, desired annual income, qualifications held, reasons for application, or other necessary information of job seekers that is obtained from the job seekers when they register, transmit or submit their resume, curriculum vitae, entry sheet, etc. to the Group in relation to the Group’s recruiting activities; information contained in any form of communication between the Company and a job-seeker during dialogues, communications and telephone calls between the Company and job seekers (including, without limitation, communications at interviews), information incidental to or derived from such information, and other necessary information; and personal information necessary for recording the history of application for or participating in the Company’s recruiting activities, and the results of the employment screening, such as the fact of being a job seeker or the history of applying for the job, status in the recruiting activities, and the Company’s evaluation and decision on the job seeker;
• Appearance of customers, employees, or others concerned contained in videos shot with cameras installed in the facilities operated by the Company;
• Name, e-mail address, other contact information, passport number, and license number of the Company’s employees; and
• Information of employees of the Company’s business partners, such as name, name of the company/department to which the employee belongs, title, telephone number, facsimile number, e-mail address, other contact information, entry/exit information, and other personal information contained in the logs of rent devices.
4. Provision of personal information to third parties
When providing goods or services, the Company uses online services offered by third parties as part of its system and also uses support from supplier manufacturers or service vendors.

Otherwise, the Company does not provide third parties with any personal information acquired from business partners or you unless:
• You agree to or approve the provision in advance;
• The Company needs to provide the personal information to any manufacturer, supplier, customer, or partner for the purpose of providing maintenance services for products sold by the Company to its customers, executing software licensing or other agreements, and providing various goods, services, or solutions;
• The Company provides the personal information of participants in a seminar or webinar held (hosted, co-hosted, supported, or sponsored) by the Company to the co-holder or supporter of the seminar or webinar;
• The Company sells the data acquired by it for AI learning;
• The provision is based on Laws and Regulations;
• The provision is necessary for the protection of the life, body, or property of an individual and it is difficult to obtain your consent;
• The provision is especially necessary for improving public health or promoting the sound growth of children, and it is difficult to obtain your consent;
• It is necessary to cooperate with a state organ, a local government, or an individual or a business operator entrusted by either of the former two in executing the affairs prescribed by Laws and Regulations, and obtaining your consent is likely to impede the execution of the affairs concerned; or
• The provision is to a university, public research institution, or other research institution, and falls under Items (v) to (vii) of Article 27(1).
The Company plans to submit a notification under Article 27(2) of the Personal Information Protection Act, and expects to provide personal data by the opt-out procedure under the same Article from , September 1st, 2024. Below are the matters concerning the provision of personal data by the Company:

At your request, the Company suspends the provision of personal data to third parties.

(4) How to update personal data provided to third parties
Each time the Company acquires new information, the database created based on the personal information acquired by the Company is updated by checking the new information against the existing personal data.
5. Joint use of personal information
In some cases including the cases below, the Company may jointly use personal information among the companies of the Group to provide comprehensive services of the Group.
In the case of joint use, the Company shall clarify in advance (1) the items of the personal information to be used jointly; (2) the scope of the joint users; (3) the purpose of use by the joint users; and (4) the name or appellation and the address (and the representative’s name in the case of a corporation) of the person responsible for the management of the personal information.

The Company will select an outsourcee that meets the Company’s outsourcee selection criteria, and conduct necessary and appropriate supervision over the outsourcee in compliance with the Laws and Regulations, Guidelines, and other rules.
7. Preparation of anonymized personal information and provision of the anonymized personal information so prepared to third parties
The Company prepares anonymized personal information (meaning information on individuals that can be prepared by processing personal information in a way that it impossible to identify a specific individual) by continuously taking appropriate protection measures against the information acquired from employees of the Company’s business partners or users in a way that it is impossible to identify a specific individual and restore the personal information to its original state. In compliance with the Laws and Regulations, Guidelines, and other rules, the Company properly handles anonymized personal information and takes necessary and appropriate security measures to prevent divulgence, loss, or damage of the information or otherwise manage the information. The Company also conducts necessary and appropriate supervision over employees or outsourcees that handle anonymized personal information.

10. Additional applicable legislation
If you are a resident of a foreign country or in a foreign country (“Foreign Country”), you are subject to the Privacy Policy for the relevant Foreign Country.
